Terms of Service
Overview of Our Terms of Service
Welcome to Access Analog. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Access Analog, LLC (“Access Analog,” “we,” “us,” or “our”), a Colorado limited liability company headquartered in Longmont, Colorado. These Terms govern your access to and use of the Access Analog website (accessanalog.com), the Analog Matrix plugin and standalone application, all associated services, and any content made available through the platform (collectively, the “Service”).
Access Analog provides cloud-based, real-time access to genuine analog audio hardware. When you use our Service, your audio is streamed to physical equipment in our facility and processed through real analog circuits, not digital emulations. This is a service, not a sale of goods. You are licensing access to our platform and hardware, not purchasing any physical equipment.
By creating an account, downloading the Analog Matrix plugin, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
These Terms incorporate by reference our Privacy Policy, Cookie Policy, Refund & Cancellation Policy, Acceptable Use Policy, and End User License Agreement (EULA) for the Analog Matrix plugin. Where those policies address specific topics in greater detail, they control with respect to those topics.
1. Description of Services
1.1 What Access Analog Provides
Access Analog is a cloud-based platform that gives musicians, recording engineers, producers, and other audio professionals real-time access to a curated collection of premium analog outboard gear. Our equipment – valued at over $300,000 – includes compressors, equalizers, saturators, limiters, reverbs, channel strips, and complete mastering chains. The Service includes:
- The Analog Matrix plugin and standalone application, which serve as the interface between your digital audio workstation (DAW) and our analog hardware.
- Robotic control technology that precisely adjusts the physical knobs, buttons, switches, and selectors on each piece of hardware in response to your plugin inputs, DAW automation, and preset recalls.
- Real-time audio streaming infrastructure that routes audio from your DAW, through the selected analog hardware, and back to the plugin.
- A reservation system for scheduling dedicated time on specific equipment.
- On-demand access to any available equipment without a reservation.
- Preset creation, storage, and recall for individual devices and full signal chains of up to eight devices.
- An offline processing mode that allows you to upload audio to our servers, process it through hardware, and download the result at full resolution (24-bit/96 kHz).
1.2 Service, Not Product Sale
Your use of Access Analog constitutes the purchase of a service – specifically, temporary access to remotely controlled analog audio hardware and associated infrastructure. You are not purchasing, renting, leasing, or otherwise acquiring any ownership interest in any physical equipment. The analog hardware remains the property of Access Analog at all times and is located exclusively at our facility in Longmont, Colorado.
1.3 Audio Conversion and Signal Path
Audio processed through the Service undergoes analog-to-digital and digital-to-analog conversion, using professional-grade converters. Conversion specifications and converter assignments are displayed in the plugin interface for each device.
1.4 Equipment Catalog
The specific equipment available through the Service may change over time. We regularly add new devices, and we reserve the right to remove, replace, or temporarily take equipment offline for maintenance, calibration, repair, or other operational reasons. The current equipment catalog is available on the Reserve page of our website. We will make reasonable efforts to provide advance notice when permanently removing equipment, but we cannot guarantee it.
1.5 Availability and Access
Each piece of analog hardware can only be used by one user at a time. When utilization for a specific device reaches an average of 30% in a given month, we typically add an additional unit to the inventory. Equipment availability is subject to demand, reservations by other users, and maintenance schedules. On-demand access is available only when the desired equipment is not currently in use or reserved.
2. Account Registration and Eligibility
2.1 Account Creation
You must create an account to use the Service. When registering, you agree to provide accurate, current, and complete information and to update your information as necessary to keep it accurate and complete. Each individual may maintain only one account unless expressly authorized by Access Analog.
2.2 Age Requirement
You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement.
2.3 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not authorized by you. You agree to notify us immediately at [email protected] if you become aware of any unauthorized use of your account. Access Analog will not be liable for any loss arising from unauthorized use of your account.
2.4 Free Trial Credits
New accounts receive a one-time allocation of free credits (currently 12 credits, equivalent to approximately one hour of access). These credits are subject to the same terms as purchased credits and are provided to allow new users to evaluate the Service. Access Analog reserves the right to modify or discontinue the free credit allocation at any time.
3. Subscription and Payment Terms
3.1 Ways to Access the Service
Access Analog offers three methods of accessing the Service, each with its own pricing and terms:
a) Subscription Plans
Subscription plans provide recurring monthly access to equipment. Plans vary in structure and may include credit allocations, time-based access to a set number of devices, unlimited access, or dedicated mastering chain time. Current subscription plans and their specific inclusions, pricing, and terms are detailed on the Subscriptions page of our website.
Key subscription terms:
- All subscriptions are billed monthly in advance on the calendar anniversary of the original subscription date.
- Subscriptions renew automatically each month unless cancelled before the renewal date.
- Unlimited tiered plans: Provide varied, unlimited access to certain equipment in the main Access Analog rack – plan and choice specific.
- Mastering chain subscriptions (Infrasonic / Magic Garden): Provide dedicated monthly time allocations on specific mastering chains, with time allocations that increase over the first two months.
b) Credit Bundles
Credit bundles are one-time purchases of credits that can be used to reserve equipment or access it on demand. Credits never expire. Available bundles range from 15 to 400 credits. Reservation and on-demand pricing is displayed for each piece of equipment and is denominated in both dollars and credits at the same rate. Current bundle pricing is listed on the Credits page of our website.
c) Reservations
You may reserve specific equipment for a specific date and time using credits or direct payment. Reservation pricing varies by device and is displayed on the booking calendar for each piece of equipment. Reservations guarantee that the selected gear will be available exclusively for you during the reserved time window.
3.2 Payment Processing
All payments are processed through third-party payment processors, currently including Stripe and PayPal. By making a purchase, you agree to the terms and conditions of the applicable payment processor. Access Analog does not store your complete credit card information on our servers.
3.3 Taxes
Prices displayed on the website are exclusive of applicable taxes unless otherwise stated. You are responsible for any sales tax, use tax, VAT, or other taxes imposed by your jurisdiction in connection with your use of the Service.
3.4 Automatic Renewal and Cancellation
Subscriptions renew automatically each billing cycle. You may cancel a subscription at any time through your account settings. Upon cancellation:
- Your subscription benefits will continue until the end of the current billing period.
- No further charges will be made after the current period.
- To avoid renewal charges, you must cancel before the renewal date.
- Refunds for renewal charges may be available within 24 hours of an unwanted renewal, at the discretion of our support team.
For complete details on refunds and cancellations, please refer to our Refund & Cancellation Policy.
3.5 Subscription Changes
You may upgrade or downgrade your subscription at any time through your account settings. Changes take effect at the next renewal date.
3.6 Price Changes
Access Analog reserves the right to modify pricing for subscriptions, credit bundles, and reservations at any time. Price changes for subscriptions will take effect at the beginning of the next billing cycle following the change. We will provide reasonable notice of price changes via email or on-site notification.
3.7 Gift Cards
Access Analog offers gift cards that can be applied to account balances. Gift cards are subject to their own terms and conditions as stated at the time of purchase. Gift cards have no cash value and cannot be redeemed for cash.
4. License Grant
4.1 Platform License
Subject to your compliance with these Terms and payment of any applicable fees, Access Analog grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or professional audio production purposes. This license does not include:
- Any right to sublicense, resell, or redistribute access to the Service.
- Any right to use the Service on behalf of third parties for compensation, except in the normal course of professional audio production (e.g., a mix engineer using the Service to process a client’s audio).
- Any right to access the underlying server infrastructure, source code, or proprietary systems beyond what is exposed through the Analog Matrix plugin interface.
4.2 Plugin License
The Analog Matrix plugin and standalone application are licensed, not sold, to you under the terms of our End User License Agreement (EULA). By downloading, installing, or using the plugin, you agree to the EULA. The EULA governs your rights and restrictions with respect to the plugin software, including limitations on reverse engineering, redistribution, and modification. In the event of a conflict between these Terms and the EULA regarding plugin-specific matters, the EULA controls.
4.3 Revocation
Access Analog may revoke your license at any time if you violate these Terms, the EULA, the Acceptable Use Policy, or any other applicable policy. Upon revocation, you must cease all use of the Service and uninstall the Analog Matrix plugin and standalone application from all devices.
5. User Responsibilities
5.1 Technical Requirements
You are responsible for ensuring that your equipment and internet connection meet the requirements necessary to use the Service. At a minimum, this includes:
- Internet connection: A stable, wired broadband internet connection is strongly recommended. Wireless and mobile connections may result in degraded performance, buffering, or dropped sessions.
- Compatible operating system: macOS (Intel or Apple Silicon) or Windows as specified on our Downloads page.
- Compatible DAW: The Analog Matrix plugin supports AU, AAX, VST, and VST3 plugin formats. Certain DAWs have specific configuration requirements (e.g., Reaper requires disabling Anticipative FX Processing; Pro Tools has a 340 ms delay compensation limit; Logic has a 1,000 ms delay compensation limit). These DAW-specific requirements are documented on our Support page.
- Network configuration: TCP port 47300 must be open in your firewall or router for audio streaming to function.
5.2 Latency and Connection Variability
The Service involves real-time audio streaming over the internet. You acknowledge and accept that:
- Latency is inherent in the Service and varies based on your geographic location, internet service provider, network conditions, and selected routing option (Standard or AWS).
- Buffer sizes between 340 ms and 2,500 ms are available to balance latency against connection stability. Smaller buffers provide lower latency but require a faster, more stable connection.
- Access Analog provides tools to manage latency (server selection, AWS Global Fast Lane routing, offline processing mode, adjustable buffer settings) but does not guarantee any specific latency figure.
- Connection quality may fluctuate during a session due to factors outside of Access Analog’s control, including general internet congestion, ISP throttling, or local network activity.
5.3 Audio Quality Expectations
You acknowledge that:
- Real analog hardware has inherent variability. While we calibrate our equipment daily, subtle sonic differences between sessions are a natural characteristic of analog processing, not a defect.
- Audio quality during real-time streaming may differ from audio captured through the offline processing mode, which provides the highest-fidelity result (24-bit/96 kHz).
- For critical work, we recommend using the offline processing mode (source upload and bounce) to capture lossless audio free from any streaming artifacts.
5.4 Reservation Etiquette
When you reserve equipment, you are securing exclusive access to a shared physical resource. You agree to:
- Be ready to use the equipment at your reserved time.
- Cancel reservations you no longer need as early as possible to make the gear available to other users.
- Not reserve equipment with the sole intent of preventing other users from accessing it.
Reservation cancellation terms, including the 10-minute cancellation window and late-cancellation fee, are detailed in our Refund & Cancellation Policy.
6. Intellectual Property
6.1 Access Analog’s Intellectual Property
Access Analog and its licensors own all rights, title, and interest in and to the Service, including but not limited to:
- Patents: The technology underlying the Service is protected by U.S. Patent #10,140,08 and potentially additional patents or patent applications.
- Trademarks: “Access Analog,” “Analog Matrix,” and associated logos, taglines, and visual identities are trademarks or service marks of Access Analog, LLC. All rights reserved.
- Copyrights: The Analog Matrix plugin software, user interface designs, website content, blog posts, tutorial videos, documentation, and photography are protected by copyright.
- Trade Secrets: The robotic control mechanisms, server architecture, signal routing systems, and calibration processes constitute proprietary trade secrets.
- Presets: Factory presets and presets created by endorsed engineers for Access Analog are the intellectual property of Access Analog or its licensors.
6.2 Third-Party Trademarks
The names and logos of third-party equipment manufacturers referenced on our website and in our plugin (including but not limited to Manley, SSL, Universal Audio, Rupert Neve Designs, Neve, API, Tube-Tech, Empirical Labs, Pultec, Avalon, Bricasti, Chandler, Gyraf Audio, and others) are the trademarks of their respective owners. These names are used solely to identify the specific physical equipment available through the Service. Access Analog’s use of these trademarks does not imply endorsement, sponsorship, or affiliation with these manufacturers unless a formal partnership is explicitly stated.
6.3 Your Audio Content
You retain all rights, title, and interest in and to the audio content you process through the Service. Access Analog claims no ownership of your audio. By using the Service, you grant Access Analog a limited, temporary license to transmit, route, and process your audio solely for the purpose of delivering the Service to you. This license terminates when your audio processing session ends, and your audio data is no longer on our servers.
We do not listen to, monitor, analyze, or store your audio content beyond what is technically necessary to deliver the Service. Audio streams pass through the hardware in real time; any audio uploaded for offline processing is stored temporarily on our servers and is available for you to download. For more information, please see our Privacy Policy.
6.4 User-Created Presets
Presets you create through the Service are yours. You may save them to your account, recall them at any time, and use them in any project. Access Analog does not claim ownership of user-created presets. However, by saving presets to our platform, you grant Access Analog a non-exclusive, royalty-free license to store and reproduce those presets solely for the purpose of providing them back to you through the Service.
6.5 Restrictions
You may not:
- Copy, reproduce, distribute, or create derivative works based on any Access Analog intellectual property without prior written permission.
- Remove, alter, or obscure any patent, trademark, copyright, or other proprietary notices on any Access Analog materials.
- Use Access Analog’s name, logo, or trademarks in any advertising or promotional material without prior written consent.
- Claim that any technology, technique, or output of the Service is your own invention or proprietary method.
7. Prohibited Conduct
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Without limiting the Acceptable Use Policy, you agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law.
- Intentionally transmit audio signals designed to damage or stress equipment beyond its normal operating parameters (e.g., sustained DC offset, extreme clipping, or signals at levels that exceed safe operating thresholds).
- Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code or underlying technology of the Analog Matrix plugin, our server systems, or the robotic control mechanisms.
- Access or attempt to access equipment, servers, or accounts that are not assigned to you.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Use automated scripts, bots, or other tools to reserve equipment, manipulate availability, or gain unfair access to the Service.
- Share your account credentials with any other person or allow multiple individuals to use a single account.
- Resell, sublicense, or commercially redistribute your access to the Service, including selling session time to third parties.
- Use the Service to process audio content that is unlawful, infringes the rights of others, or that you do not have the right to process.
- Circumvent or attempt to circumvent any access restrictions, usage limits, or technical protection measures implemented by Access Analog.
Violation of these prohibitions may result in warning, suspension, or permanent termination of your account, at Access Analog’s sole discretion. In cases of intentional equipment damage, you may be held financially liable for repair or replacement costs.
8. Third-Party Services
The Service relies on certain third-party services to operate. These include, but are not limited to:
- Amazon Web Services (AWS): Provides network infrastructure, including the AWS Global Fast Lane routing option.
- Payment Processors (Stripe, PayPal): Handle all payment transactions, subscription billing, and refund processing.
- Email Services: Deliver transactional emails (account confirmation, receipts, reservation reminders) and marketing communications.
- Analytics Providers: Collect anonymized usage data to help us improve the Service, as described in our Privacy Policy and Cookie Policy.
Access Analog is not responsible for the performance, availability, or actions of any third-party service. Outages, errors, or changes in third-party services that affect the Access Analog platform are not considered breaches of these Terms. If a third-party service disruption materially affects your ability to use the Service, we will work to resolve the issue as quickly as possible and may offer credits or refunds at our discretion, as described in our Refund & Cancellation Policy.
Your use of third-party services (for example, your agreement with Stripe or PayPal to process payments) is governed by the respective third party’s terms and conditions. We encourage you to review those terms.
9. Disclaimers and Limitation of Liability
9.1 “As-Is” and “As-Available”
THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ACCESS ANALOG DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
9.2 No Guarantee of Results
Access Analog does not guarantee any specific sonic outcome, audio quality, or creative result from use of the Service. The sonic characteristics of your processed audio depend on many factors, including your source material, equipment settings, signal chain choices, monitoring environment, and your own judgment as an audio professional. The Service provides the tools; the results depend on how you use them.
9.3 No Guarantee of Availability
While we target 99% uptime for the platform and calibrate equipment daily, we do not guarantee uninterrupted or error-free operation of the Service. Equipment may be temporarily unavailable due to maintenance, calibration, hardware failure, or high demand. Specific devices may be removed from the catalog at any time.
9.4 Internet and Connectivity
The Service requires a functioning internet connection. Access Analog is not responsible for audio quality issues, session interruptions, or data loss caused by your internet connection, ISP, local network conditions, or general internet routing between your location and our servers in Longmont, Colorado.
9.5 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ACCESS ANALOG, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF ACCESS ANALOG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9.6 Liability Cap
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ACCESS ANALOG’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO ACCESS ANALOG IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
9.7 Applicability
Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for certain types of damages. In such jurisdictions, the above limitations and exclusions may not apply to you in full, but shall apply to the maximum extent permitted by the law of your jurisdiction.
10. Indemnification
You agree to indemnify, defend, and hold harmless Access Analog, LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:
- Your use of the Service.
- Your violation of these Terms, the Acceptable Use Policy, or any other applicable Access Analog policy.
- Your violation of any third-party right, including any intellectual property, privacy, or proprietary right.
- Any audio content you process through the Service.
- Any claim that your use of the Service caused damage to a third party.
This indemnification obligation shall survive the termination of your account and these Terms.
11. Dispute Resolution
11.1 Governing Law
These Terms, and any dispute arising out of or relating to these Terms or the Service, shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict-of-law principles.
11.2 Informal Resolution
Before initiating any formal dispute resolution process, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. We will make good-faith efforts to resolve any concern or dispute within thirty (30) business days.
11.3 Binding Arbitration
If a dispute cannot be resolved informally within thirty (30) business days, you and Access Analog agree that the dispute shall be resolved through binding arbitration conducted in Boulder County, Colorado, in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted by a single arbitrator. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
11.4 Class Action Waiver
You and Access Analog agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.
11.5 Exceptions
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
11.6 Small Claims
Either party may bring an individual action in small claims court in Boulder County, Colorado (or in your county of residence, if different) for disputes within the jurisdictional limits of such court.
12. Modification and Termination
12.1 Modification of Terms
Access Analog reserves the right to modify these Terms at any time. When we make material changes, we will:
- Update the “Last Updated” date at the top of this page.
- Provide notice through email to the address associated with your account, an in-app notification, or a prominent notice on our website.
- Give you at least fourteen (14) days’ notice before material changes take effect, except where changes are required to comply with legal obligations or to address security concerns, which may take effect immediately.
Your continued use of the Service after the effective date of any modification constitutes your acceptance of the modified Terms. If you do not agree with the modified Terms, you may cancel your subscription and close your account before the changes take effect.
12.2 Modification of Service
Access Analog may, at any time and without prior notice:
- Add, modify, or remove features, functionality, or content within the Service.
- Add or remove equipment from the available catalog.
- Change technical specifications, including supported plugin formats, operating systems, or DAW compatibility.
- Modify server infrastructure, routing options, or audio conversion equipment.
We will make reasonable efforts to communicate significant changes that may affect your workflow, but the dynamic nature of our service — which involves maintaining and evolving physical hardware — means that the catalog and capabilities will change over time.
12.3 Termination by You
You may terminate your account at any time by cancelling all active subscriptions and contacting us at [email protected] to request account deletion. Upon account termination:
- All subscription benefits cease immediately (or at the end of the current billing period, per your cancellation terms).
- Any unused credits that are not subject to bonus credit clawback remain available for a period of ninety (90) days, during which you may contact us to request a refund in accordance with the Refund & Cancellation Policy.
- Presets saved to your account will be permanently deleted.
- You must uninstall the Analog Matrix plugin and standalone application from all devices.
12.4 Termination by Access Analog
Access Analog may suspend or terminate your account, with or without notice, if:
- You violate these Terms, the Acceptable Use Policy, the EULA, or any other applicable policy.
- We reasonably believe your account has been compromised or is being used fraudulently.
- You fail to pay any amounts owed to Access Analog.
- We are required to do so by law, regulation, or legal process.
- We discontinue the Service (in whole or in part).
In the event of termination for cause (your breach), Access Analog is not obligated to provide refunds for any prepaid amounts. In the event of termination by Access Analog for any other reason, we will provide a pro-rata refund of any prepaid subscription fees for the unused portion of the current billing period.
12.5 Discontinuation of Service
Access Analog reserves the right to discontinue the Service entirely, with reasonable notice (at least thirty (30) days). In such event, we will provide pro-rata refunds for any prepaid subscription fees and refunds for any unused credit balances.
12.6 Survival
The following sections survive termination of these Terms: Intellectual Property (Section 6), Disclaimers and Limitation of Liability (Section 9), Indemnification (Section 10), Dispute Resolution (Section 11), and any other provisions that by their nature should survive.
13. General Provisions
13.1 Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, Refund & Cancellation Policy, Acceptable Use Policy, and EULA, constitute the entire agreement between you and Access Analog regarding the Service and supersede all prior agreements, understandings, and representations.
13.2 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
13.3 Waiver
The failure of Access Analog to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any term shall only be effective if in writing and signed by an authorized representative of Access Analog.
13.4 Assignment
You may not assign or transfer these Terms, or any rights or obligations hereunder, without the prior written consent of Access Analog. Access Analog may assign these Terms without restriction in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.
13.5 Force Majeure
Access Analog shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, pandemics, war, terrorism, labor disputes, power failures, internet outages, or equipment failures.
13.6 Notices
We may provide notices to you by email to the address associated with your account, by posting a notice on the website, or through the plugin interface. You may provide notices to us by email at [email protected].
13.7 Relationship of the Parties
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Access Analog. You are an independent user of the Service.
